Terms of Service
These Terms of Service ("Terms") govern your use of ProofHaul, operated by ProofHaul, LLC ("ProofHaul," "we," "us," or "our"). By using the service, you agree to these Terms.
1. The Service
ProofHaul provides operational SMS notifications and load reconciliation tools for commercial truck drivers and small carriers. The service includes:
- Parsing rate confirmation documents
- Tracking load lifecycle events (pickup, delivery, POD)
- Sending operational SMS updates related to your loads
- Generating Load Reconciliation Packets
ProofHaul is currently in beta. Features may change without notice.
2. SMS Communications
By texting START, sending load paperwork to ProofHaul via SMS/MMS, or texting a claim number we provide, you consent to receive operational text messages from ProofHaul regarding the loads and documents you submit. These messages include but are not limited to load confirmations, pickup confirmations, POD reminders, GPS proof links, and packet delivery. Consent is not a condition of purchase.
- Message frequency varies based on load activity.
- Message and data rates may apply.
- Reply STOP at any time to opt out of SMS communications. Reply STOP to opt out.
- Reply HELP for support. Reply HELP for help, or email support@proofhaul.com.
- ProofHaul does not send marketing or promotional SMS messages.
3. Eligibility
You must be at least 18 years old and authorized to use the phone number you provide. You agree to provide accurate information and to use the service only for lawful purposes.
4. Your Responsibilities
You are responsible for:
- The accuracy of rate confirmations and load information you submit
- Verifying the accuracy of any information ProofHaul extracts or summarizes
- Independently confirming pay, proof, and compliance requirements with your broker, carrier, or shipper
- Securing your phone number and email account
- Compliance with all applicable laws, regulations, and contractual obligations
5. No Warranty / No Legal or Financial Advice
ProofHaul is provided "as is" and "as available" without warranties of any kind, express or implied. ProofHaul is a software tool. It does not provide legal, financial, or compliance advice. Information surfaced by ProofHaul, including risk flags and reconciliation packets, is informational only and does not constitute advice.
You are solely responsible for decisions made based on information from ProofHaul, including decisions related to pay disputes, contract terms, regulatory compliance, and load acceptance.
6. Limitation of Liability
To the maximum extent permitted by law, ProofHaul, LLC and its officers, employees, and contractors are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost pay, or business interruption, arising from your use of the service. Our total aggregate liability for any claim arising from or related to the service is limited to the greater of (a) one hundred dollars ($100) or (b) the amount you have paid ProofHaul in the twelve (12) months preceding the claim.
7. Indemnification
You agree to indemnify and hold harmless ProofHaul, LLC from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any law or third-party right.
8. Termination
We may suspend or terminate your access to ProofHaul at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the service at any time by replying STOP to opt out of SMS and ceasing further use.
9. Changes to These Terms
We may update these Terms. Continued use of the service after changes constitutes acceptance. Material changes will be communicated via the service.
10. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Missouri.
